Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Lumen Sieve platform, API, and related services (collectively, the "Service") provided by Lumen Sieve ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing the API, or using any part of the Service, you confirm that you have read, understood, and agree to these Terms, together with our Privacy Policy. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.
If you do not agree to these Terms, you may not use the Service.
2. The Service
Lumen Sieve provides a business intelligence API that discovers, reconciles, and delivers structured profile data for businesses from their name and location. The Service includes profile lookup, field-level source attribution, Ask Lumen Sieve natural-language queries, and related developer tooling.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.
3. Accounts and API Keys
To access the API you must create an account and obtain an API key. You are responsible for:
- Maintaining the confidentiality of your API keys.
- All activity that occurs under your account.
- Immediately notifying us at security@lumen.com if you suspect any unauthorised access or key compromise.
- Revoking compromised keys without delay using the dashboard or the API.
Secret keys are shown exactly once at creation. We store only a one-way hash and cannot recover or display a key after it has been issued.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to build or train competing machine-learning models or data products without our written consent.
- Resell, sublicense, or redistribute raw API output as a standalone data product.
- Attempt to circumvent rate limits, quotas, or access controls.
- Use the Service to facilitate illegal discrimination, harassment, or privacy violations against individuals.
- Reverse-engineer, decompile, or attempt to extract the underlying source data, models, or algorithms.
- Introduce malicious code, conduct denial-of-service attacks, or otherwise interfere with the Service or its users.
- Access or scrape data beyond what is returned by authorised API calls.
We reserve the right to suspend or terminate accounts that violate these restrictions, with or without notice, depending on severity.
5. Plans, Billing, and Quotas
The Service is offered under a tiered pricing model described on the Pricing page. Your plan determines your monthly quota of profile lookups and feature access.
- Paid plans are billed monthly or annually in advance.
- Overages are either blocked (soft limit) or billed at the rates shown in your plan, depending on your configuration.
- Downgrading your plan takes effect at the start of the next billing cycle.
- Refunds are issued at our discretion for exceptional circumstances. Contact hello@lumen.com to discuss.
- On paid plans, API keys created in the test environment do not count against your monthly quota. On the Free plan, all usage counts toward the lifetime limit regardless of key environment.
6. Data and Intellectual Property
Profile data returned by the Service is derived from publicly available sources. We do not warrant the completeness, accuracy, or fitness for any particular purpose of any profile. Confidence scores and fieldsNeedingReview flags are provided to help you calibrate your own use of the data.
You retain ownership of any content you submit to the Service (for example, data corrections). By submitting corrections, you grant us a non-exclusive licence to use that information to improve profile accuracy for all users.
The Lumen Sieve platform, API, documentation, and all associated intellectual property remain the exclusive property of Lumen Sieve and its licensors. Nothing in these Terms transfers any ownership rights to you.
7. Third-Party Integrations
We are not responsible for the availability, accuracy, or terms of any third-party services referenced or integrated with the Service.
8. Uptime and Service Levels
We work to keep the Service available and reliable, but we do not offer a contractual uptime SLA on the Free, Starter, Growth, or Enterprise plans.
Custom Enterprise plans include a contractual uptime commitment and service credits for breach, as described in the applicable order form. Scheduled maintenance windows are announced in advance wherever possible.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Lumen Sieve, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR ACCESS TO OR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
11. Indemnification
You agree to indemnify, defend, and hold harmless Lumen Sieve and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.
12. Termination
You may terminate your account at any time from the dashboard or by emailing hello@lumen.com. Termination takes effect at the end of the current billing period for paid plans.
We may suspend or terminate your access immediately and without notice if you breach these Terms, if we are required to do so by law, or if continued access poses a security or legal risk. Upon termination, your API keys are revoked and your data is scheduled for deletion in accordance with our Privacy Policy.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email to the address on your account or by a prominent notice in the dashboard at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law and Disputes
These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or in connection with these Terms shall first be referred to good-faith negotiation. If not resolved within 30 days, disputes shall be resolved by binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.
